General Terms and Conditions

Drago Broadcast Services, S.L.

1. Quotations and Acceptance
Quotations issued by Drago Broadcast Services, S.L. (“DRAGO”) shall be valid for five (5) days from the date of issue and shall not constitute a reservation of equipment. Written acceptance by the Client is required and shall be deemed full and unconditional acceptance of these General Terms and Conditions. DRAGO reserves the right to amend prices where acceptance is not received within the stated period. Any variation to the agreed quotation must be approved in writing.

2. Payment Terms
Payment of the full invoiced amount, including applicable taxes, shall be made in advance prior to collection or dispatch of the equipment. Payment may be made by bank transfer, cash, or credit/debit card, unless otherwise expressly agreed in writing.

3. Equipment and Rental Period
DRAGO warrants that it owns or is duly authorized to rent the equipment. The rental period shall commence upon collection by the Client or dispatch to the Client, as applicable. Delivery shall take place at DRAGO’s premises unless otherwise agreed. Where delivery to an alternative location is requested, all transportation costs and risks shall be borne by the Client.

4. Return of Equipment and Late Charges
Equipment must be returned to DRAGO’s designated facilities no later than 12:00 p.m. on the final day of the rental period. Late returns shall incur the following charges:

  • Up to 24 hours: 80% of the daily rental fee per day

  • From 24 to 72 hours: 100% of the daily rental fee per day
    Failure to return the equipment within 72 hours may result in legal action.

5. Cancellations
Cancellations notified at least 24 hours prior to the agreed collection or delivery time shall incur a charge of 40% of the applicable daily rate. Cancellations notified less than 24 hours in advance shall incur a charge of 75% of the applicable daily rate.

6. Use and Condition of Equipment
Equipment shall be delivered in proper working order. The Client shall inspect the equipment upon collection and shall thereafter be responsible for its custody, proper use, and maintenance. The equipment shall be operated exclusively by qualified personnel and shall not be altered, dismantled, transferred, or disposed of.

7. Liability
DRAGO shall not be liable for any direct or indirect loss, damage, or injury arising from the use of the rented equipment, including but not limited to misuse, technical failure after delivery, or production-related consequences.

8. Insurance
The Client shall maintain insurance covering the full replacement value of the rented equipment. Subject to prior written request, the Client may opt into DRAGO’s insurance policy at an additional cost of 8% of the rental value, subject to policy terms, exclusions, and a deductible of €2,500 per incident and per item. Use of equipment in high-risk productions requires DRAGO’s prior written authorization.

9. Territorial Limitations
Equipment use is restricted to Spain unless expressly authorized in writing by DRAGO. Any international use shall require prior approval and compliance with all applicable insurance, customs, and regulatory requirements, at the Client’s sole expense.

10. Incidents and Claims
The Client shall notify DRAGO of any loss, damage, theft, or incident affecting the equipment within twelve (12) hours of becoming aware of such event. No claims shall be accepted after the return of the equipment. The Client shall be responsible for all damage occurring during the rental period.

11. Credits
In audiovisual productions that include end credits, the Client shall credit DRAGO as technical equipment provider using lettering of equal or greater prominence than that used for other technical suppliers.

12. Termination and Jurisdiction
DRAGO reserves the right to terminate the contractual relationship with immediate effect in the event of breach, non-payment, or insolvency of the Client. These Terms and Conditions shall be governed by Spanish law, and any disputes shall be subject exclusively to the jurisdiction of the Courts of Madrid.
